Terms of Service

1. Who we are

These Terms of Service ("Terms") are a binding agreement between you and PromptAura ("PromptAura", "we", "us", or "our"), the operator of the PromptAura website and services (the "Service"). By accessing or using the Service you agree to these Terms.

2. Acceptance

By creating an account, purchasing a plan or pack, or otherwise using the Service, you confirm that you have read and agree to be bound by these Terms. If you do not agree, do not use the Service. You must be of legal age in your jurisdiction (or have parental consent) to use the Service.

3. The Service

PromptAura provides AI-generated prompt packs, prompt tools, an AI web builder, an AI academy with certificates, and related features. Availability and functionality of specific features may change over time.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

• use the Service for any unlawful, fraudulent, or deceptive purpose;
• send spam, malware, or attempt to compromise security or scrape the Service;
• infringe intellectual property, privacy, or other rights of any person;
• generate illegal content, deepfakes of real people without consent, hate speech, sexual content involving minors, or content designed to harass, threaten, or defraud;
• attempt to jailbreak, reverse-engineer, or bypass safety filters;
• resell, sublicense, or redistribute the Service or generated outputs in violation of your plan or these Terms.

5. AI-generated content

You are responsible for the prompts you submit, for verifying the accuracy of any outputs, and for ensuring you have the rights to any content you provide as input. AI outputs may be inaccurate, incomplete, or unsuitable for regulated professional advice (legal, medical, financial, etc.) without appropriate human review. You are responsible for how you use outputs.

We may remove content, refuse or filter outputs, and suspend accounts that violate these Terms. Rights-holders who believe content on the Service infringes their rights may contact us at rotdot64@gmail.com; repeat infringers will have their accounts terminated.

6. Intellectual property

PromptAura, its software, branding, curated prompt libraries, courses, and documentation are owned by PromptAura and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with your plan. You retain rights to prompts and content you create; you grant us a limited license to host and process them solely to provide the Service.

7. Payments & subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. See our Refund Policy for details on how to request a refund.

Subscription plans renew automatically until cancelled. If you cancel a monthly subscription, associated premium access ends immediately. Lifetime unlocks and prompt-pack purchases are one-time and grant permanent access to the purchased content, subject to these Terms.

8. Service availability & disclaimer

The Service is provided "as is" and "as available". We do not guarantee uninterrupted, error-free, or secure operation. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, or incidental damages, or loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.

10. Suspension & termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, your right to access the Service ends; we may delete associated data after a reasonable period.

11. Changes

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after changes constitutes acceptance.
